Terms of Service

Thank you for using DunningBear. We build it to help SaaS founders understand why their customers cancel. Because we can't know every customer personally, we have these Terms of Service to help keep things running smoothly.
When we say "Company", "we", "our", or "us" in this document, we are referring to Forty Two Technologies, Inc., located at 2093 Philadelphia Pike #9998, Claymont, DE 19703, operating the DunningBear product. When we say "Service", we mean the DunningBear Stripe App and the dunningbear.com website. When we say "you" or "your", we are referring to the person or organization that has installed DunningBear on their Stripe account.
We may update these Terms in the future. Whenever we make a significant change, we will update the date at the top of this page. When you use our Service, now or in the future, you are agreeing to the latest Terms. These Terms do contain a limitation of our liability.
Account terms
- Your DunningBear account is tied to your Stripe account. You are responsible for maintaining the security of your Stripe account. We cannot and will not be liable for any loss or damage from a compromise of your Stripe account.
- You are responsible for all activity that occurs under your account.
- You must be a human. Accounts registered by automated methods are not permitted.
- You may not use the Service for any unlawful purpose or to violate any laws in your jurisdiction.
Payment and billing
- DunningBear is a paid service. We offer two plans: Starter ($19/month) and Pro ($39/month). Prices may change in the future; if they do, we will give at least 30 days notice via email.
- All billing is handled through Stripe. By subscribing to a paid plan, you agree to pay the applicable fees. Fees are charged monthly in advance.
- All fees are exclusive of taxes. Where required, we will collect applicable taxes on behalf of the relevant taxing authority.
- We process refunds according to our Fair Refund Policy.
Cancellation and termination
- You are solely responsible for canceling your account. You can uninstall DunningBear at any time from the Stripe Dashboard. You can also cancel your subscription from DunningBear's settings panel within the app.
- When you uninstall DunningBear, all of your data is deleted from our active systems immediately. Backups containing your data will be purged within 30 days. We cannot recover this data once deleted.
- If you cancel before the end of your current billing period, your cancellation takes effect immediately. You will not be charged again. We do not automatically prorate unused time.
- We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. We will attempt to notify you before taking action, except in cases of abuse.
Uptime, security, and privacy
- Your use of the Service is at your sole risk. We provide the Service on an "as is" and "as available" basis.
- We take many measures to protect and secure your data through backups, encryption in transit, and restricted server access.
- When you use our Service, you entrust us with your data. You agree that DunningBear may process your data as described in our Privacy Policy and for no other purpose.
- We use third-party vendors to provide the infrastructure required to run the Service. These are listed in our Privacy Policy.
Data and permissions
- DunningBear requests read-only access to your Stripe customer, subscription, and invoice data. We never write to, modify, or delete anything in your Stripe account.
- The cancellation data we store from your Stripe account is used solely to provide the analytics and insights within the DunningBear app and weekly email digest.
- For Pro tier accounts, free-text cancellation comments are sent to a third-party AI service (Anthropic Claude API) for thematic analysis. This processing is described in our Privacy Policy.
Intellectual property
- The Company owns all right, title, and interest in and to the Service, including all intellectual property rights. You obtain no ownership rights in the Service through your use of it.
- You may not duplicate, copy, or reuse any portion of the Service's code, visual design, or branding without our written permission.
Features and bugs
We design our Service with care and test it extensively. However, there is no such thing as a service that pleases everybody. We make no guarantees that the Service will meet your specific requirements or expectations. As with any software, bugs are inevitable. We track reported bugs and work through them by priority, especially anything related to security or privacy. Not all reported bugs will be fixed immediately, and we do not guarantee a completely error-free Service.
Liability
You expressly understand and agree that the Company shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Service; (ii) unauthorized access to or alteration of your transmissions or data; (iii) statements or conduct of any third party on the Service; (iv) or any other matter relating to these Terms or the Service, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability.
In other words: choosing to use our Service does mean you are making a bet on us. If the bet does not work out, that's on you, not us. We do our best to be a safe bet through careful management, investment in security, and generally giving a damn.
